Look at another view : the case of Pondok jihad land with the question of " Wa Gulf ".

Ustaz Abdul Shukur Binshaphiey (Abdulsugo Din-a) the council of Southern Civil Society and the assistant manager of the school of education ethics Foundation, Jana district, Songkhla province that they write the article by their views about Pondok jihad land which the court ordered the seizure of land vested to the state interestingly.

 

 

This issue is the feeling of the people in the area and It also has an unmatched understanding of the land or property "Wa Gulf".

          The article of Prof. Abdul Sugo states that the Issara news office reported
a part of Pondok Jihad land by the statement of Bulyan Waemanuo, the son of the former principal of the school as Dunlao Waemanue that the land belonged to the family but the school belonged to the community

          “We always say that the land belongs to the family but the wealth and property on 14 acres of land was donated (Wa Guf) of residents and communities in the area. The appeal is the agenda of the people in the area. The alumni have joined the group and talk to the community to find the best solution together but what must be accepted as law.”

          From the interview with Mr. Bulyard concluded that the properties, such as vehicles, buildings and other public properties, or Wa Guf as a postdoctoral inspired by Islam, It must be a community because the community donated them.

But the question is those properties ever made a legal act under Islamic law and Thai law as community or public or Wa Guf.

The word "Wa Gulf" is an Arabic word means a donation to charity. By the academic definition means the restrict of property to any party and contribute to its benefits by hope charity from Allah, the Lord of the Worlds. The challenge is not only to Pondok jihad (the society dare not to say) because the people see in the border southern province that Wa Gulf will organize an event asked for many donations in Pondok schools and Private Islamic Religious Teaching School or the Private Islamic Religious Teaching Institutions
(but not all institutions), by the reasons to improve education. The donation could buy the land, buildings or other conditions in Wa Gulf. But It found that many of the properties of Wa Gulf was not registered as nationalized but used the person’s name.        

Many of cases have led these properties to borrow money from the bank  and can not be redeemed. In many cases can pay by installment. In many cases that the occupants of the properties used for both personal and community.
The supportive money for student per head used for school development while someone used the money for personal.

In author’s viewpoint about the property of Wa-Guf must be revealed to the purposes of the donor. Meanwhile, it must require explicitly the need, especially the land must be registered under the foundation or the other properties which the people Wa Guf that must require explicitly to prevent problems that will occur in the Thai law. For the law of God, you will have to answer to God yourself.

One more suggestion should set the academic conference on Islamic law and Thai law how should manage these properties to the public in reality. Otherwise the people and the community that will be harmed by unintentionally.

One fault and the great sin that Allah forbids his servants, the penalties are severe, both in this world and the next world that is injustice. In the words of him who has said in the Quran as well

          The saying "Do not think Allah neglect to the practices of unjust. In fact the Allah gives them respite until the day when eyes will stare (the Hereafter) "(Abraham : 42).

         Allah said another, "So that, their houses are empty because they are unjust. Indeed, in this surely there is a sign for a people who know "(Annam ฺ: 52).

          Allah has spoken again of that. "And you do not embezzle the properties between you wrongfully" ((Al Baqarah: 188).

Prophet Muhammad have reported the message from your Lord. He said, "Oh! My servants, Indeed I have forbidden wrong to me. And I have enjoined wrong between you. So let them not wrong another "(Narrated by Muslim: 2577).
